New Jersey Supreme Court Revokes Prohibition

The New Jersey Supreme Court revoked the previous prohibition against plea bargaining in driving under the influence cases.  Referred to as Guideline 4, the Courts previously prohibited plea bargaining in all driving under the influence cases.  The New Jersey Legislature recently amended the Driving Under the Influence Statute to allow for plea bargaining.


The amended statute which was signed and effective on February 19, 2024, provides that: "[n]otwithstanding any judicial directive to the contrary, upon recommendation by the prosecutor, a plea agreement under this section is authorized under the appropriate factual basis, consistent with any other violation of Title 39 of the revised statues or offense, under Title 2C of the New Jersey Statutes."
